This Internet Web site (the “Site”) is operated by Felux, Inc. (“Felux”). Felux is committed to the protection and privacy of your personal information. To preserve the integrity of information collected from the Site, Felux adheres to the following policy (this “Privacy Policy”) to protect the privacy of personally identifiable information collected through the Site. This Privacy Policy applies only to information Felux collects through the Site or in connection with your registration with and onboarding to the Site, and does not apply to its collection of information from other sources.

INFORMATION COLLECTED

You do not need to provide any personally identifiable information to visit public sections of the Site. Felux collects personally identifiable information only if you voluntarily provide it to Felux when using the Site.

When you use certain Site functions, such as when you register for certain services, access certain content or features, or directly contact the Site, Felux may ask you to provide information, including: contact information, such as name, email address, postal address, phone number, and mobile number; username and password.

Felux cannot prevent such information from being used in a manner that may violate the law or your personal privacy and safety, and Felux is not responsible for the results of such posting.

The Site may track user involvement in Site blogs and forum discussions. For example, the Site may keep track of user-generated comments to ensure compliance with the content standards described in the Terms of Use.

USER ACCOUNTS

You can deactivate your account at any time by contacting Felux; see the Contact Information below. When you deactivate your account, your account will be disabled, but your public comments will remain on the Site. The Site has no responsibility to take down, remove, or edit any of your public activities or any submissions that are a result of your public activities.

COOKIES

Felux may use “cookies” and other similar technologies on the Site. Cookies are text files that are commonly used on many Web sites to store a user’s preferences through use of an identifier transferred to the user’s computer through the web browser. Cookies allow Felux to personalize a user’s experience on the Site, provide specialized content and support to users of the Site, compile data regarding use of the Site, recall visitor preferences, or simplify the completion of online forms. HOW FELUX USES INFORMATION

The personally identifiable information you provide to Felux is generally used to carry out your requests, respond to your inquiries and for Felux’s own administrative, sales, marketing, service and product development purposes.

Depending on the information that you provide and the contact preferences you have indicated, Felux may contact you by letter, email, fax, telephone, short message service (“SMS”) or other telecommunication messaging. By submitting personally identifiable information to Felux, you consent to Felux’s use of the information as set out in this Privacy Policy.

Unless Felux obtains your prior written consent, it will not sell, rent, trade or share any personally identifiable information that it collects from the Site to third parties except:

  • Felux reserves the right to use IP addresses to identify a visitor or disclose any personally identifiable or non-personal information about you if Felux believes that such action is necessary to: (i) fulfill a government request; (ii) conform with the requirements of the law, regulations or legal process; (iii) protect or defend Felux’s legal rights or property, the Site or other users; (iv) respond to claims that any posting or other Content violates the rights of third parties; (v) in an emergency, protect the health and safety of the Site’s users or members of the general public; (vi) detect, prevent, or otherwise address fraud, security or technical issues; and (vii) enforce compliance with the Terms of Use, including investigation of potential violations thereof, the terms of which are incorporated by reference.
  • Felux may share aggregated non-personal information about you and de-identified individual data and profiles with third parties. This is information that is combined with the non-personal information of other users and does not allow you to be identified or contacted. Depending on the circumstances, we may or may not charge third parties for this aggregated information. We also may not limit the third parties' use of the aggregated information or de-identified individual data.
  • Felux does not share non-aggregated information about your sales or purchases of products or your offers to do so with its successors, parents, subsidiaries, affiliates and related companies or other companies under common control that Felux may have now or in the future (“Affiliated Companies”). As Felux continues to develop its business, Felux may sell or purchase assets. In the event of a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation Felux may transfer, sell or assign to third parties information concerning your relationship with Felux, including, without limitation, personally identifiable information that you provide and other information concerning your relationship with Felux.
  • Felux may disclose your personally identifiable information to its legal, accounting, marketing or other professional advisors and business partners who assist Felux by performing services related to the operation of the Site or the processing and fulfillment of product or service orders, such as hosting, billing, fulfillment, data storage, security, processing credit card payments or delivering products or services.

Felux uses non-personal information in a variety of ways, including, but not limited to, analyzing Site traffic, understanding customer needs and trends, and improving the services offered. Felux may use your non-personal information by itself or aggregate it with information obtained from other users. Felux may share your non-personal information with its Affiliated Companies and third parties to achieve these objectives.

DIRECT MARKETING

Felux operates a policy of opt-in marketing. The contact details you provide (including, but not limited to, your telephone number, fax number, mailing address and email address) may be used by Felux to send you information about products and services. Your contact details will not be provided to any third parties for the purposes of direct marketing. Your contact details will only be used to send you information about products and services if you have previously indicated your consent to receiving such messages. You may opt-out from receiving such messages at any time by sending an email to the address listed in the “Contact Information” provision below with the word “UNSUBSCRIBE” in the subject-line. All marketing messages sent to you by email will contain a statement re-iterating these instructions.

WIRELESS DEVICE MESSAGING

Felux may provide users with the opportunity to register for services and information delivered via text messaging and other wireless device messaging services (e.g., SMS) and, in the event Felux engages in such wireless device messaging, users are required to provide their consent to receive such information by registering on the Site or via their wireless device. Felux may require you to consent to the receipt of such wireless device messages in a subsequent confirmation message. The information requested as part of the online registration process may include your wireless telephone number or email address and your carrier’s name.

If you register to receive wireless device messages, you understand and agree that you MAY be charged by your wireless carrier for all such messages sent to you. Standard messaging rates will apply, unless noted otherwise. Under no circumstances will Felux be responsible for any wireless email or text messaging charges incurred by you or by a person that has access to your wireless device, telephone number or email address.

You may cancel SMS messaging at any time by following the instructions in the text message or by replying with STOP, STOPALL, UNSUBSCRIBE, END or QUIT.. If you unsubscribe to wireless device messaging, the service(s) will be terminated and will cancel your previous opt-in. You may continue to receive the service(s) for a limited period of time while your cancellation is processed. You understand, acknowledge and agree that Felux may, in its sole discretion and without liability to you, terminate any offer of any specific and/or general wireless device messaging service at any time without advance notice. Felux may provide notice of terminations or changes in service on the Site.

PROCEDURES USED BY FELUX TO PROTECT YOUR PRIVACY

Felux has implemented security measures to protect against the loss, misuse and alteration of the information under its control, including Secure Sockets Layer (“SSL”) technology to encrypt the transmission of nonpublic, personally identifiable information over the Internet. Felux also uses additional security devices, including, but not limited to, firewalls, security patches and anti-virus programs to protect personally identifiable information.

Felux does not represent or warrant the security of any information you disclose or transmit to felux on the site. Felux is not responsible for the unauthorized access, loss, misuse, alteration, theft, destruction or inadvertent disclosure of your personally identifiable information. Felux disclaims liability for personally identifiable information submitted through the site. You are hereby advised that the submission of personally identifiable information on the site is at your own risk.

In the event that the security or integrity of your personally identifiable information is compromised, Felux may notify you by email (at Felux’s sole and absolute discretion) to the last email address you have provided to Felux in a reasonable time given the circumstances; provided, however, delays in notification may occur while Felux takes necessary measures to determine the scope of the breach and restore reasonable integrity to the Site and Felux systems or if notification would impede a criminal investigation.

LINKS TO OTHER SITES

The Site may contain a link to another Web site operated by a third party (a “Linked Site”). Felux is not responsible for the content of a Linked Site or your use of a Linked Site. A Linked Site may have its own privacy policy in place, which Felux recommends you review if you visit a Linked Site. Felux does not control and is not responsible for what third parties do in connection with their website or how they handle your personally identifiable information.

The Site may include functionality that allows integration with third party sites, including, but not limited to, Twitter, Facebook, LinkedIn and other social network sites. Felux may allow you to share selected information with those third party sites, and you may be permitted to export information concerning your use of the Site to such third party sites. Some of those third party services may provide Felux with information to enhance and personalize your use of the Site. If you submit credentials (e.g., username and password) for a third party website or service during your registration for the Site or in connection with updating your user profile, Felux may receive your information from such third party website or service.

ACCESS TO, MODIFICATION OF, AND CORRECTION OF, YOUR PERSONALLY IDENTIFIABLE INFORMATION

You may request in writing to the email address listed under the “Contact Information” provision below that Felux amend any personally identifiable information that it holds about you. Felux will respond to your request and, if applicable and appropriate, will make the requested change in its active databases as soon as reasonably practicable. Felux may request proof of identity prior to disclosing your personally identifiable information. Felux may not be able to fulfill certain requests while allowing you access to certain benefits and features on the Site. In the event Felux amends your personally identifiable information upon your request, Felux may retain a copy of the previous version for its records. Because of the way Felux maintains certain services, after you delete your information, residual copies may take a period of time before they are deleted from Felux’s active servers and may remain in Felux’s backup systems.

CHILDREN’S ONLINE PRIVACY

The Site is a general audience site and does not knowingly collect or store personally identifiable information about Site visitors under the age of 13. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personally identifiable information to Felux please contact Felux in writing at the email address listed under the “Contact Information” provision below. CALIFORNIA PRIVACY RIGHTS

Residents of the State of California, United States of America have the right to request from certain businesses with whom the California resident has an established business relationship a list of all third parties to which the business, during the immediately preceding calendar year, has disclosed certain personally identifiable information for direct marketing purposes. Felux is only required to respond to a customer request once during any calendar year. If you are a resident of California and would like to obtain this information, you can send a written request to the email address listed under the “Contact Information” provision below with the heading “California Privacy Rights.” In your request, please attest to the fact that you are a California resident and provide a current California address. Not all information sharing is covered by the california privacy rights requirement and only information on covered sharing will be included in felux’s response.

CHANGES TO THIS POLICY

The Effective Date of this Privacy Policy is May 1, 2019. Felux may amend our privacy policy at any time by posting a revised version on this website. The revised version will be effective at the time we post it.
